5. Quotations
Requests submitted through the website are requests for information or quotations and do not automatically create a binding agreement.
A quotation becomes binding only once:
- ECH Consultancy has issued a written quotation
- the client has accepted the quotation in writing
- any required deposit has been received; and
- any required site inspection, technical assessment or credit approval has been completed.
Unless otherwise stated, quotations remain valid for the period shown on the quotation.
Prices may change if the project scope, quantities, site conditions, labour requirements, supplier prices, transport costs or statutory requirements change after the quotation is issued.
6. Orders and acceptance
All orders are subject to acceptance by ECH Consultancy.
We may decline or cancel an order where:
- A product is unavailable
- Incorrect product or pricing information was displayed
- Payment has not been received
- Delivery or installation cannot reasonably be completed
- The requested work would not comply with applicable requirements
- Fraudulent or unauthorised activity is suspected; or
- Circumstances outside our reasonable control prevent fulfilment.
Where payment has already been received for a cancelled order, the appropriate amount will be refunded, subject to any lawful deductions or costs already incurred with the client’s approval.
7. Prices and payment
Prices will be communicated on the website, in writing or through a formal quotation.
Unless stated otherwise:
- Prices are quoted in South African rand
- VAT will be included or added where applicable
- Delivery, installation, travelling, accommodation, certification and specialised equipment costs may be charged separately
- Deposits may be required before products are ordered or work begins; and
The outstanding balance must be paid according to the payment terms stated on the quotation or invoice.
ECH Consultancy may suspend delivery, installation or services where payment is overdue.
Ownership of supplied products remains with ECH Consultancy until full payment has been received, to the extent permitted by law.
8. Site inspections and client responsibilities
The client must provide accurate information about the property, equipment, risks, access requirements and intended application.
Where work is performed at a client’s premises, the client must:
- Provide safe and reasonable access to the site
- Inform us of known hazards and site rules
- Ensure that required areas are accessible
- Obtain any permissions required from landlords, body corporates, municipalities or other authorities
- Provide access to electricity, water or other facilities where reasonably required; and
- Ensure that authorised representatives are available when necessary.
Additional costs caused by incorrect information, restricted access, unsafe conditions, delays or changes requested by the client may be charged separately.
9. Installation, maintenance and compliance
Fire-protection systems and equipment must be selected, installed, inspected and maintained in accordance with applicable legislation, standards, manufacturer instructions and site requirements.
Any compliance statement, certificate or report will apply only to the equipment, system, area and condition assessed at the time of inspection.
The client remains responsible for:
- Following operating and maintenance instructions
- Arranging future inspections and servicing when due
- Reporting damage, faults or alterations
- Preventing unauthorised modifications; and
- Maintaining overall workplace and building compliance.
No website content or general recommendation constitutes a guarantee that a property is fully compliant.
10. Delivery
Delivery dates are estimates unless expressly confirmed as guaranteed in writing.
Delivery may be affected by stock availability, supplier delays, weather, access restrictions, transport disruptions and other circumstances outside our reasonable control.
The client must inspect delivered products and report visible shortages or damage as soon as reasonably possible.
Risk in the products passes to the client upon delivery or collection, subject to applicable consumer law.
11. Cancellations and returns
Cancellation and return rights will be handled in accordance with applicable South African law and the specific terms of the accepted quotation.
Standard, unused products may be considered for return where:
- A return request is submitted within the applicable period
- The product is unused, complete and in its original packaging
- Proof of purchase is provided; and
- The product is suitable for resale.
The following may not ordinarily be returnable, except where defective or where required by law:
- Custom-made or specially ordered products
- Products altered or installed for the client
- Used safety equipment
- Products damaged through misuse or incorrect storage
- Items with broken seals where safety or hygiene is relevant; and
- Services already performed.
Approved returns may be subject to collection, delivery or reasonable handling costs where legally permitted.
12. Defective products and workmanship
Clients must notify ECH Consultancy of a suspected defect as soon as reasonably possible and provide relevant photographs, documents and access for inspection.
Any warranty is subject to:
- Correct use and storage
- Compliance with maintenance requirements
- No unauthorised alterations or repairs
- Normal operating conditions; and
- The manufacturer’s applicable warranty terms.
Warranty cover does not ordinarily include normal wear and tear, accidental damage, misuse, vandalism, environmental damage or failure caused by third-party work.
Nothing in these terms limits any mandatory rights available under applicable consumer law.
13. Emergency situations
This website and its contact forms are not emergency-reporting services.
In an active fire, medical emergency or immediate danger, contact the appropriate emergency services without delay. Do not rely on an email, website form or quotation request for emergency assistance.
14. Intellectual property
All website content, including text, graphics, logos, layouts, photographs, product information and design elements, is owned by or licensed to ECH Consultancy unless stated otherwise.
